Errors & Omissions
Errors & Omissions (E&O) is loss arising out of failure to provide ‘Professional Services’. An E&O loss is all sums which the Insured is legally liable to pay because of a Wrongful Act.
E&O cover provides protection against:
Negligent misstatement or misrepresentation (including advice of goods).
Libel, slander and / or defamation.
Breach or misuse of confidentiality or any right to privacy.
Infringement of intellection property rights.
Our E&O policy extends cover to:
Contamination Costs
Complaint and Investigation Costs
Court Attendance Compensation
Media Management Costs
Fidelity (optional)
Any many more…
Some examples of E&O in the Medical field include:
A Physiotherapist prescribes intense training exercises for a patient recovering from knee surgery, overlooking previous medical history indicating a mild heart condition, leading to chest discomfort due to overexertion.
A Radiologist suggests to a client that their nodule is benign, however after a six-month check-up a Physician confirms it to be cancerous, resulting in delayed treatment.
A Speech Pathologist conducts an initial assessment for a child with a speech delay, forgetting to document key observations about the child’s articulation and fails to discuss a follow-up plan with the parents. Additionally, the treatment plan is not updated in the system to reflect the child’s specific needs.
